Authenticity
All objects offered for sale on StoryLTD by Saffronart are authentic to the best of Saffronart’s knowledge.
Saffronart provides the following assurance to buyers on StoryLTD with regard to authenticity:
All objects, other than antiquities
Objects offered for sale on StoryLTD (other than antiquities) are offered on behalf of a seller who may be a collector, dealer, retailer or gallery. Saffronart is selective in signing on suppliers with a strong history of quality and credibility.
Where Saffronart deems necessary, its team of experts examines the object’s provenance - including relevant documentation made available by the seller, and conducts independent research .
Sellers on StoryLTD provide an assurance that the key characteristics described on the Saffronart website of such items, are accurate. In the rare instance that the authenticity of the item is questioned by a buyer, the claim is handled as below. for the following kinds of objects.
1. "Artworks" – including but not limited to paintings, prints, sculptures, installations and new media art.
2. "Precious Objects" – defined as jewellery, watches, loose precious stones, and any objects made of precious metals or precious stones.
3. "Other Objects" – defined as any objects not covered in (1) or (2).
Authenticity Guarantee for Artworks
StoryLTD provides an assurance on behalf of the seller that each object we offer for sale is genuine and authentic.
Saffronart guarantees the authenticity of the Artwork for a period of one year. Authenticity in relation to Artworks shall mean compliance of the Artwork with the description provided on the web site, particularly with reference to the name of the artist, title (if any) of the Artwork itself, date, the school of art (if mentioned), dimensions, medium etc.
In the unlikely event that within one year from the sale of the Artwork, it is proved by the buyer to the reasonable satisfaction of Saffronart that the item was not authentic and if, in Saffronart's opinion, this would have significantly impacted the price a buyer would have been willing to pay for the item, Saffronart shall be entitled to rescind the sale and the seller will be liable to refund to the buyer the price paid for the item, once the buyer returns the item to Saffronart. Saffronart shall hand over to the seller the item returned by the buyer.
All such claims will be handled on a case-by-case basis, and in the case of an authenticity claim in relation to Artwork will require that examinable proof, which clearly demonstrates that the item is not authentic, is provided by an established and acknowledged authority. The decision of Saffronart in respect of such claims shall be final and binding.
Authenticity of Precious Objects and Other Objects
In the case of Precious Objects and Other Objects, Saffronart offers an assurance on behalf of the seller that the item shall comply with characteristics or features mentioned in the heading (title) of the the item on the website, till such time that the item is in the possession of Saffronart (in the case of Precious Objects) and till 7 working days from the day the item has been delivered to the buyer (in the case of Other Objects). It is therefore advisable for buyers or potential buyers of such items, particularly if they are of high value, to request Saffronart for an inspection of the item. Saffronart will, to the extent practicable and commercially reasonable, coordinate with the sellers for any such request for inspection.
In the unlikely event that during such an inspection (in the case of Precious Objects) or within 7 working days from the day the item has been delivered to the Buyer (in the case of Other Objects), the buyer is able to prove to the reasonable satisfaction of Saffronart that the item does not match the details given in the heading to the item, and if, in Saffronart’s opinion, this error or omission would have significantly impacted the price a buyer would have been willing to pay for the item Saffronart shall be entitled to rescind the sale and the seller will be liable to refund to the buyer the Sale Price paid for the item. The buyer shall return the item to Saffronart and Saffronart shall hand over the item to the Seller upon refund of the sale price paid to him for the item. Once Saffronart obtains the refunded amount from the Seller, it shall forward the same to the buyer. This guarantee will not be applicable to Precious Objects where the item is being shipped to the buyer by Saffronart.
All such claims will be handled on a case-by-case basis. The decision of Saffronart in respect of such claims shall be final and binding.
Further Conditions
The above claims for Artworks, Precious Objects and Other Objects shall be subject to the following conditions:
1. The claim is made by the buyer as registered with Saffronart (the benefit of the claim is not assignable to any subsequent owners or others who may acquire or have an interest in any of the items).
2. The item is returned in the same condition that it was in at the time of delivery of the item to the buyer.
3. The item was indisputably purchased through Saffronart.
Saffronart retains the right to consult with, at the expense of the buyer, two recognized experts in the field, (such experts being mutually acceptable to Saffronart and the buyer), to examine the item under question before deciding to rescind the sale and offer the refund under the above guarantee. The opinion of the experts shall not be binding on Saffronart.
In the event of the seller's failure to refund the proceeds as stated above, the buyer shall return the item to Saffronart and authorize Saffronart as its agent to initiate legal proceedings against the seller. Any such steps taken or legal proceedings instituted by Saffronart against the seller shall be to the cost of the buyer.
Opinion in relation to antiquities
Antiquities located in India are offered for sale by Saffron Art Private Ltd. through the Saffronart website, and are defined as antiquities under the Antiquities Act and Art Treasures Act, 1972. Antiquities located outside India are offered for sale by Planet Saffron Inc based in New York, a subsidiary of Saffronart Management Corporation.
In the case of antiquities, any statement made by Saffron Art Private Ltd. or Planet Saffron Inc. in relation to such item, whether orally or in writing, concerning its attribution, like any school of art or craftsmanship, country or origin, history, authenticity or provenance, are only expressions of Planet Saffron Inc’s or Collectible Antiques (India) Private Limited's opinion or belief and do not constitute a representation, warranty or assumption of liability of them in any manner whatsoever and Planet Saffron Inc./Saffron Art Private Ltd. will not be liable for errors or omissions in any of the opinions with respect to authenticity, provenance, description, or condition of such items. Planet Saffron Inc or Saffron Art Private Ltd. does not in any way represent that it has carried out exhaustive research or analysis, and it is therefore necessary, especially in cases of items of high value, to request Saffronart on behalf of Saffron Art Private Ltd. or Planet Saffron Inc. for an inspection of such items and potential buyers may seek advice on such matters from their own professional advisors.
Saffron Art Private Ltd. and Planet Saffron Inc. shall, where commercially reasonable and practicable procure that adequate representations and warranties are obtained from the sellers with respect to the antiquities offered for sale, for the benefit of the buyers. The buyer should however, keep in mind that the breach of any such representation or warranty by the seller or any dispute arising therefrom shall be settled between the seller and the buyer and neither Saffron Art Private Ltd. nor Planet Saffron Inc. will have any liability whatsoever with respect to any such breach of warranty or dispute.
